       (2)Against one whose education, training, apprenticeship or tutorship is entrusted to the offender;

       (3)When the sexual favor is made a condition to the giving of a passing grade, or the granting of honors and scholarships, or the payment of a stipend, allowance or other benefits, privileges, or considerations; or

      (4)When the sexual advances result in an intimidating, hostile or offensive environment for the student, trainee or apprentice.

  10. Good day, thanks for posting some cases related in sexual harassment. As i go through with it, i was not able to find a sample case of sexual harassment violated by a teacher. It will be a great help for us to give us some samples of decided cases violated by a teacher.

    this is the facts and issue.

    A. FOR THE COMPLAINANT: MR. A. ASKAL
    Mr. Alex Askals, the 17-year old OJT molested by MR. PIOLO MANZANO, a 37 year old, Branch Manager and outstanding CHEF, two (2) times as he required the OJT to an out-of-town food festival in Boracay then promised money and job if he agreed to be his lover.
    B. FOR THE RESPONDENT: MR. P. MANZANO
    1. MR. PIOLO MANZANO, denying the allegations of sexual harassment.
    2. Mr. Piolo, who is married to the niece of Mr. Andrew Zobel and rumored to be bisexual. And is now separated from Krissy Zobel, his wife of five years with one child. Testifying that .Azkal is a distant cousin of her ex-wife and that Azkal was precisely “planted” to falsely incriminate Mr. Manzano and also a means for retaliation against him for separating from the Zobel scion.

    case: THE ALLEGED CASE OF REDUNDANCY AND RETRENCHMENT

    D.1 FACTS
    1. The JBJ COMPANY INC. is the owner of a chain of hotels and motels which has been in operation for three (3) generations of family owners in the last 100 years.
    2. In the last five (5) years, however, the Company has suffered from an unabated financial losses which have substantially eroded the capitalization and assets of the Company.
    3. Some of the causes of these losses are:
    (3.1) Stiff competition;
    (3.2) Rising Cost of Operation including cost of power, electricity, water and
    taxes;
    (3.3) Rising Labor Costs ;
    (3.4) Low productivity; and
    (3.5) Intramurals among owners who are cousins and their respective spouses.

    4. As HR Director handling the HR services in 27 hotels, motels, and restaurants with a total manpower of 3,700 non-unionized, you are being asked to recommend to top management a LABOR-SAVING DEVICE in order to reduce labor cost by half.
    5. Outline your proposal, including the steps in accordance with Art. 283 of the Labor Code, citing the required DOCUMENTATION and REPORTS.
    6. Cite the PROBABLE PROBLEMS that may arise and indicate your proposed solution.
    7. Would it be different if the Company had an employee union?

    8. What are you proposals to enhance the Labor Code provisions related to labor-saving devices, restaurants, redundancies, and closures?
